1. Scope & Incorporation
These Terms and Conditions ("Terms") of Beacon Garage Doors LLC ("Contractor") govern every customer contract, quote, estimate, work order, or other written proposal. "Customer" means the individual or business entering the agreement.
2. Services
Contractor will perform services according to industry standards applicable to garage door installation and repair services in Utah.
3. Estimates
- Estimates are valid for 30 days.
- Estimates exclude changes in scope or design after acceptance.
4. Acceptance / Approval
Work begins only upon written approval (email accepted). Changes post-approval may incur additional charges.
5. Payment Terms
- Homeowners: 50% deposit required, balance due on completion.
- Contractors: 100% payment required upfront unless agreed otherwise in writing.
6. Special Orders
Customer is responsible for verifying special-order details. Returns due to dissatisfaction (excluding damage) are the customer's responsibility.
7. Delinquent Accounts
Delinquent invoices accrue interest and may be referred to collections. All collection costs are the customer's responsibility.
8. No Withholding; Termination for Non-Payment
Customer may not withhold payment for alleged defects. Non-payment voids warranties and allows Contractor to terminate services.
9. Site Conditions
Customer must ensure safe access to the work site and indemnify the Contractor for issues beyond their control.
10. Door Opening
Contractor is not responsible for damage or issues caused by missing jambs or casings unless previously arranged in writing.
11. Customer Responsibility to Clear & Secure Site
Customer must remove all obstructions, pets, and valuables from the work area. Contractor is not liable for damage if this is not done.
12. Limited Warranty
- 1-year limited warranty on materials and workmanship.
- Excludes damage due to misuse, acts of God, or unauthorized modification.
- Paint must be 100% acrylic latex (LRV ≥ 55).
- Claims must be made in writing within 24 hours of discovery.
DISCLAIMER: THIS IS THE ONLY WARRANTY. ALL OTHERS ARE DISCLAIMED.
13. Prompt Customer Inspection
Customer must inspect work within 48 hours. Failure to notify Contractor voids all warranties.
14. Unforeseen / Concealed Conditions
Customer is responsible for any concealed or unforeseen issues that affect installation or repair.
15. Additional Work
Additional work outside the original scope will be billed separately and must be approved in writing.
16. Licenses, Permits & Fees
Contractor may obtain permits. Fees for permits and licenses are the customer's responsibility.
17. Limitation of Liability
Contractor is not liable for incidental or consequential damages. Maximum liability is limited to the amount paid by the customer.
18. Hold Harmless & Indemnity
Customer agrees to indemnify and hold Contractor harmless against claims arising from the customer’s negligence or failure to maintain safe conditions.
19. Services Not Covered
Unless specified, services do not include carpentry, electrical, painting, masonry, landscaping, etc.
20. Termination by Contractor
Contractor may terminate work for non-payment, misrepresentation, or breach. Customer remains liable for costs incurred.
21. Governing Law, Jurisdiction & Venue
All disputes will be handled in accordance with Utah law in the courts of Weber County, Utah.
22. No Waiver
Failure to enforce any provision is not a waiver of future rights.
23. Amendment
Changes to these Terms require written agreement by both parties.
24. Application
These Terms apply to all future agreements unless replaced in writing.
